These Terms of Service ("Terms") govern your use of the website www.vanguardit.org and the services provided by Vanguard IT Solutions LLC ("Vanguard IT," "we," "our," or "us"). By accessing our website or engaging our services, you agree to these Terms.

1. Services

Vanguard IT Solutions LLC provides managed IT services, cybersecurity solutions, network support, security camera installation, business VoIP, AI answering services, custom software development, and related technology services to businesses in the Rio Grande Valley and surrounding areas. Specific services, deliverables, and fees are described in individual service agreements or statements of work signed by both parties.

2. Payments and Billing

• Invoices are due upon receipt unless otherwise stated in your service agreement.
• Recurring service fees are billed on the schedule set forth in your agreement (monthly, quarterly, or annually).
• Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the agreed fees.
• Charges from Vanguard IT Solutions LLC will appear on your statement as VANGUARD IT SOLUTIONS or similar.
• Late payments may be subject to a 1.5% monthly finance charge.

3. Refunds and Disputes

If you believe a charge was made in error, contact us within 30 days of the charge date:

We will review your concern promptly and issue a credit or refund if the charge was made in error. Refunds for prepaid services are evaluated on a case-by-case basis per your service agreement.

4. Acceptable Use

You agree not to use our website or services to:

• Violate any applicable law or regulation
• Transmit malicious code, spam, or unauthorized data
• Infringe on the intellectual property rights of others
• Interfere with the operation of our systems or third-party systems

5. Intellectual Property

All content on this website – including text, graphics, logos, and software – is the property of Vanguard IT Solutions LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of our business relationship. This obligation survives the termination of any service agreement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Vanguard IT Solutions LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability for any claim arising from a service agreement shall not exceed the fees paid by you in the three (3) months preceding the claim.

8. Disclaimer of Warranties

Our website and services are provided "as is." We make no warranties, express or implied, regarding uptime, fitness for a particular purpose, or freedom from errors, except as expressly set forth in a signed service agreement.

9. Termination

Either party may terminate a service agreement in accordance with the termination provisions in that agreement. We reserve the right to terminate access to our website for users who violate these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Cameron County, Texas.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes your acceptance of the updated Terms.
